Does PayPal ever work for Section 75?

There could be circumstances where the necessary relationship may exist. For example, larger retailers may use it as a “merchant acquiring service”, which means it acts as a traditional payment processor. Yet, it's very difficult to tell – so to be on the safe side, assume not.

If you’re going to get really nerdy on this (ignore this bit if you don’t want nerd-dom), it’s worth noting there are some court rulings which can be read as contradicting the Ombudsman’s view. In other words, that Section 75 does apply to PayPal, most notably if the retailer has entered into a commercial entity agreement with PayPal.

@HighlandTiger - from the same article:

 - As the Ombudsman route is easier (and allows you to go to court after if you don’t like what it says, but it doesn’t work the other way round) my preference is to stick with it – which means following its interpretation, which is pretty clear that in most cases it won’t uphold Section 75 claims via PayPal.

But, you can chargeback (generally):

- If your card is used directly through PayPal. If there’s no money loaded and your card is used directly to make a transaction through PayPal then chargeback should apply.

I do hope people get their coins or money back. I for one am glad I didn’t buy from these guys, just felt too fishy from the start. 

I am 100% sure they are not connected to H&B. The directors of H&B have been involved in numismatics for a while. 

My only advice is to always check the company out before you buy.

I’ve followed this thread with interest even though I only collect silver. Is there any way the members of the forum that have been stung could get together and take out a joint action against Buckingham Collections?

I've escalated to a claim through PayPal, as all I've been getting is empty promises. I'll get in touch with my bank about a charge back. 

Failing that I'll open a claim through my legal cover

I been reading this thread with interest , i don't normally contribute to the forum but enjoy reading it. I would advise people owed money to push very quickly for a settlement before this company files for bankruptcy . It seems they have been running some sort of a ponzi scheme , and now with the sudden rise in gold it's about to collapse. It looks very likely that is were they are heading, and once they do i'm afraid that's that regards to making a claim. I'd obviously recommend no one else deals with this company.

This is terrible tbh. I really hope you all get sorted with refunds at least. If I'd have seen at least one picture post in 'today I received' from the BC, I'd have likely been in the same boat, as that's what eventually prompted me into trying out H&B.

As RichRock has posted from companies house, they seem to have a fishy record of regularly changing company names and addresses all round Bournemouth, and hardselling things like washing machine insurance.

I found a couple more interesting links from sites I'd use myself when I don't recognise a phone number coming up on the display. The Royston middle name makes googling a bit easier, where people mention it.

I found another relatively recent link from companies house, only published on 10 June it says, that doesn't make for good reading either and kind of backs up what you're saying there @Pipers
